Nabarro LLP’s Sheffield construction practice delivered a High Court victory for a new client – seven days after being appointed.Nabarro was instructed by Bell Group, the UK's largest independent commercial and industrial painting firm, which was facing imminent proceedings relating to a dispute with facilities service company Dalkia.
Dalkia had launched proceedings in the Technology and Construction Court to prevent Bell Group pursuing an independent adjudication over a disputed contract relating to repair and painting works at 143 railway stations and 22 footbridges.
Nabarro was recommended by the Dubai office of international construction consultants Currie & Brown, who had compiled Bell Group’s adjudication referral.
In seven days, including two days of court hearings, a Nabarro team led by partner Ian Radford secured a judgement in favour of its new client. Dalkia's proceedings were thrown out by the court in their entirety, with a substantial costs order awarded in Bell Group's favour.
A couple of days later, Nabarro secured an award from the adjudicator giving Bell Group 100% of its substantive claims, together with all the costs incurred in the adjudication process and a punitive interest award – a total of some £300,000.
"It is very unusual for a case to be turned around so quickly – and also very unusual to win 100% of the claim and costs," says partner Ian Radford. "This was a complex, challenging case and it was very satisfying to deliver such a positive result for a new client. This result is also further proof of Nabarro's ability to steer a complex case through the London courts from our Sheffield office."
